Lk Files Third Wave of Lawsuits in Flint Michigan, Case Filings Now Total 75 Lead-poisoned Children

March 17, 2016 – Today, twelve families joined Lee-Anne Walters and Tammy Loren, in filing individual lawsuits in the Circuit Court of Genesee County in Flint, Michigan, on behalf of 25 children who were lead poisoned by water in Michigan’s 7th largest City. The twelve families, represented by the New York-based law firm Levy Konigsberg LLP, and the Flint-based Robinson Carter & Crawford PLLC, are now among thirty-one families for whom the firms have filed individual lawsuits on behalf of 75 lead-poisoned children.

The 12 complaints, each 40 pages in length, name six corporate entities that had various responsibilities with respect to the treatment, monitoring, and safety of the Flint water prior to and during the Flint Water Crisis. The corporations include Lockwood, Andrews & Newnam, Inc., based in Houston, Texas; Rowe Engineering, Inc., based in Flint, Michigan; and Veolia North America, Inc., a Chicago-based company that is part of the United States operations of Veolia Environment, a publicly-traded company based in France (NASDAQ: VEOEY). The lawsuits also name 3 individual government, or former government, employees who played significant roles in the misconduct that led to the poisoning of thousands of children in Flint.

The firms representing the Plaintiffs are preparing additional individual case filings on behalf of a large number of other parents of children in Flint who have been lead-poisoned. Like Walters, Loren, and the 19 families that have previously filed, the 12 new families filing these individual lawsuits are moving forward with these actions even though various attorneys have filed proposed class actions that seek to include lead-poisoned children.

Corey Stern, one of the attorneys for the families, said: “We will continue to file individual lawsuits for every child that was lead poisoned as a result of exposure to the water in Flint. The fact that so many children were lead-poisoned is not grounds for each child not having their own case.”

In the opening paragraph in each of the individual Complaints filed today, the Plaintiff's state: “Only this individual lawsuit – and not a class action – is able to redress and fully compensate the individual harm suffered by Plaintiff’s children.” Attorney Corey Stern who specializes in litigating individual lawsuits on behalf of lead-poisoned children, stated: “This third wave of cases represents our continued commitment to allowing the voices of the children in Flint to be heard. Like the 19 cases filed over the last two weeks, these cases are about the children and the individual harm that has been done to them.”

Mr. Stern continues to shuttle back-and-forth between Flint and his New York City office, meeting with Flint parents, community leaders, and members of the clergy. Stern and his firm have been working closely with Robinson Carter & Crawford in evaluating hundreds of cases of children lead poisoning in Flint. Mr. Stern recently participated in a town hall meeting in Flint, presented by Flint Neighborhoods United, on March 10, 2016, Titled: “Today and Tomorrow: Water in Flint” along with representatives of the Environmental Protection Agency and the Governor’s Office.
