NEW YORK, New York, October 19, 2007 – A team of lead paint lawyers at Levy Konigsberg LLP obtained a verdict totaling $4,645,000.00 in a lead poisoning lawsuit1 on behalf of a child, who was 15 years old at the time of trial and 4 years old when he was poisoned from his apartment building’s lead paint. The lawyers substantiated the lead poisoning lawsuit by showing that for a period of approximately one year, while residing in a Manhattan apartment building, the child was exposed to peeling and chipping lead based paint and lead based paint dust. The lead paint lawyers then went on to argue the apartment owner and manager’s liability for the child’s lead poisoning.

The jury agreed with the lead paint lawyers by concluding that the corporate owner and manager of the apartment building were negligent in failing to maintain the apartment in accordance with the Laws of the State and City of New York. The jury also agreed with the lead paint lawyers that lead poisoning liability should be placed on the owner of the building, because the owner had been aware of lead paint hazards in the building by virtue of the Department of Health’s issuance of lead paint violations against the owner 10 years prior to the infant plaintiff moving into the apartment building. The jury also found that the infant’s lead poisoning was a substantial factor in causing his cognitive, attention, and learning deficits, one of the lawsuit’s main arguments for seeking compensation.

As a result of his lead poisoning, the lead paint lawyers went on to explain how the infant failed the third grade, had to repeat the third grade, and had failing grades in most of his major subjects through the 8th grade. The plaintiff also suffers from learning disabilities, caused by the lead poisoning, which have resulted in his far below average academic performance.
