Theresa A. Vitello
Of Counsel at Levy Konigsberg LLP, Theresa specializes in false claims act litigation, including whistleblower claims under the Dodd-Frank Act, the Internal Revenue Code, and other local, state and federal laws. She also focuses on class action and multi-district litigation involving consumer fraud, medical and pharmaceutical fraud, banking, finance and insurance law, and other commercial matters.
Since joining the firm, Theresa has successfully handled qui tam cases, class action matters and major trials. Most recently, Theresa represented the relator in U.S. ex rel. Dr. Gabriel Feldman v. the City of New York, 09-CIV-8381 (JSR), a federal false claims act case filed in the Southern District of New York, which resulted in a $70 million recovery for the United States government and $14.7 million relator's share. For her work on the Feldman matter, Theresa was featured along with LK founding partner, Alan Konigsberg, in New York Magazine's Best Lawyers "Cover Stories and Exceptional Cases," December 2011 edition. Recently, Theresa was selected one of Super Lawyers, 2013 New York Metro Rising Stars for her accomplishments.
Theresa's trial experience with the firm includes Bamira v. Parker Chapin Flattau & Klimpl, LLP, a breach of fiduciary duty suit, which resulted in a verdict of $5 million in punitive damages and $2 million in compensatory damages. Prior to joining LK, Theresa worked on In Re: IPO Securities Litigation, 21 MC 92 (SAS), a class action involving violations of the federal securities laws in the Southern District of New York. She also worked on In Re: Diet Drugs Products Liability Litigation, MDL No. 1203, a multi-district litigation concerning the diet drug fen-phen.
Theresa is licensed to practice law in New York, New Jersey, and Pennsylvania. She is also licensed to appear before several federal district courts, including: the Southern District of New York, the District of New Jersey and the Eastern District of Pennsylvania. She is a member of the New York Bar Association, the New Jersey Association for Justice and the Nassau County Bar Association.
Theresa graduated from Villanova University School of Law in 2002. While there, she was an executive member of the Moot Court Board, and a teaching and research assistant in the legal writing department. In 1999, she earned her undergraduate degree from Fairfield University where she graduated magna cum laude and was inducted into Phi Beta Kappa.
