Trucker Stricken with Mesothelioma Takes Asbestos Companies to Court

A New Jersey man who worked as a trucker, transporting asbestos-containing products for fifty years, files a personal injury lawsuit against several asbestos companies after a diagnosis of mesothelioma, an asbestos-caused cancer.

NEW YORK, New York, December 20, 2013 – A mesothelioma victim who worked for nearly 50 years as a trucker in the New York and New Jersey area will see his day in court, ruled a New York Supreme Court on December 9, 2013.

The ruling came after one asbestos defendant attempted to dismiss the plaintiff’s case. The court’s ruling, however, ensures that the victim will be able to see his case through to a New York jury. Mesothelioma lawyers from Levy Konigsberg LLP (“LK”) represent the victim.

The lawsuit alleges that the plaintiff spent his career picking up and delivering goods to various sites in Manhattan, as well as manufacturing plants in New Jersey. One such manufacturing plant was the Union Carbide Company Bakelite Plant in Bound Brook, New Jersey. There, the plaintiff would load and unload bags of products that the lawsuit alleges contained high concentrations of asbestos.

The products in question, like many other products manufactured with asbestos for decades prior to late 1970s – early 1980s, contained no warnings that their contents were harmful and capable of causing injury, including cancer.

“Rulings such as this one demonstrate that the New York court system is more than prepared to ensure that mesothelioma victims get their chance to tell their story to a jury,” said LK mesothelioma attorney Robert Komitor.
