Mesothelioma Lawyers Win $7.3M for Family of Asbestos Victim

Mesothelioma lawyers from the nationally-acclaimed asbestos law firm Levy Konigsberg LLP won $7.3 million for the family of a mesothelioma victim after a six-week trial in New York County Supreme Court against defendant Union Carbide.

NEW YORK, New York, April 25, 2014 – Robert Komitor and a team of mesothelioma lawyers from the national asbestos litigation firm of Levy Konigsberg LLP (“LK”) represent the family of a career truck driver who was regularly exposed to asbestos in Union Carbide’s Bakelite molding materials from approximately 1953 to 1963 and, as the result of this exposure, had developed and later died from mesothelioma, a lethal cancer caused by asbestos.

LK’s client visited Union Carbide’s Bakelite plant in Bound Brook, New Jersey on a weekly basis over a nine-year period. During that time, he loaded thousands of bags of material that was later melted down to create plastic products. As the LK client explained in his testimony, these bags would often break, spilling dust on his clothes and the interior of his truck, which he later swept up. LK lawyers explained to the jury using Union Carbide’s internal documents from the time period, as well as other evidence, that the Bakelite Bound Brook plant made materials comprising up to 30% asbestos at the time their client was going there.

LK’s expert witness explained that exposure to asbestos in this product over a nine-year period was sufficient to cause the client’s cancer: pleural mesothelioma. As the expert further explained, pleural mesothelioma is a deadly, incurable cancer that can develop decades after exposure to asbestos.

The LK client’s family carried on his lawsuit after he died from mesothelioma before trial.

“The jury’s decision, in this case, is a great illustration of the justice system at work for victims of mesothelioma in New York,” Komitor said.
