New York Sex Abuse FAQ

Childhood sex abuse is among the most damaging crimes committed against children including teenagers. The cases of abuse we handle include sex crimes by priests, other clergy, teachers, therapists, coaches, or other people in positions of authority and trust. These criminal acts may have been committed decades ago, but the individuals must be held accountable, and fair compensation paid to victims. If you were a victim of child sex abuse, get answers to common questions about your rights and how to move forward with legal action against the perpetrator.

If the Abuse Occurred Years Ago, Can I File an Adult Survivor Act Lawsuit?

The Adult Survivors Act in New York, passed on May 24, 2022, has extended the amount of time a victim of child sex abuse has to file a claim. The new law allows those sexually abused in New York at any time after they turned 18 year of age to have a one year window from the date the law came into effect. This one-time window closes on November 23, 2023. Legal actions that were not possible in the past can be revisited and may allow for victims who previously were barred from filing a claim to pursue justice at last. The law allows for claims to be filed against the abuser as well as public and private institutions that were aware of the abuse, or should have reasonably known, to be held accountable. If you were sexually abused in the State of New York at any time after you turned 18 years of age, then you may qualify for a lawsuit under the Adult Survivors Act. We urge you to act quickly and speak with us about your legal rights.

How Much is a Sex Abuse Case Worth in Compensation?

The amount awarded in a settlement or by a jury in civil court will vary, based on the facts in the case. The extent of the trauma suffered in the incident, the long-term impact on the mental and emotional health of the victim, and whether the institution was aware that abuse was occurring all come into play when negotiating the terms of a settlement, or when seeking justice in court. The first step is to speak with a child abuse lawyer in New York who has an extensive record of positive outcomes in sex abuse cases.

At What Age Can You File a Child Sex Abuse Claim?

Many victims of sex abuse may have been reluctant to come forward and speak about their experience. They may have been threatened, fearful, or were afraid to tell their parents what was occurring. Many adults who were abused as children are ashamed about what occurred, and did not report it, but are finally prepared to seek justice and compensation for the long-term damage they suffered at the hands of an abuser.

Although the “look back” window for child sex abuse cases has closed, there are some circumstances in which more recent victims of child sex abuse can still file claims until age 55. If you were sexually abused as a child in New York, please contact us so we can explain your legal rights. In coming forward with a child sex abuse claim, you have a rare opportunity to finally achieve justice, compensation, and hold the responsible individual and organization for which they worked accountable. Your actions can save others from facing a similar tragedy.

What Crimes are Considered Sex Abuse?

Sex abuse comes in many forms, including first, second, or third degree rape, sexual misconduct, first, second or third degree criminal sexual acts, forcible touching, persistent sexual abuse, first, second, and third degree sexual abuse, aggravated sexual abuse, and others. A civil lawsuit can be based on any unwanted sexual touching or exploitation. Victims of these crimes often experience a lifetime of emotional anguish. The trauma experienced in these cases goes far beyond any physical damage, typically leaving long-lasting emotional damage. State lawmakers have made it possible to hold these criminals accountable for their actions, even when the abuse occurred decades ago.

What is the Statute of Limitations in Sex Abuse Cases in New York?

The crime of first degree rape has no statute of limitations for criminal prosecution in New York. Rape is defined as non-consensual sexual intercourse, committed with force, or committed on a physically helpless individual, or a child under 11 years old. For civil case, statutes of limitation in New York for rape range from 10 to 20 years based on the degree and severity of the rape under criminal statutes. You should contact our law firm with any questions about statutes of limitations or your legal rights. Many people who were barred from filing a claim, were reluctant to do so for various reasons, including threats, the fear of not being believed, or feeling ashamed, but are now prepared to seek justice.
