Smile Direct Club Lawsuits

Tesla Lawsuits

Smile Direct Club provides consumers with teeth-straightening aligners through a direct mail program. The custom-made aligners are intended to eliminate the need for in-person visits to the orthodontist. However, users of Smile Direct Club aligners have reported that the aligners can crack and damage teeth and cause significant pain. Lawsuits against Smile Direct Club maintain that the product is unsafe, and that the manufacturer fails to supervise its use.

What is Smile Direct Club?

Smile Direct Club is a direct-to-consumer platform that offers affordable and convenient teeth straightening options. The aligners work in the same way as braces by applying gradual pressure in order to shift teeth into their desired position. Smile Direct Club customers take a scan or an impression at home. These images are sent back to the manufacturer, which custom produces aligners for each patient. The company alleges that each patient’s care is reviewed and approved by a state licensed dentist or orthodontist in accordance with its “Smile Guarantee”.

What is Happening with Smile Direct Club?

Customers who use Smile Direct Club aligners have reported that the product caused pain and damage to their teeth, jaw, and mouth. While some customers complained that the aligners failed to improve their teeth, others have alleged that the aligners created significant and irreversible injury. Patients have also reported head pain associated with changes to their teeth. The aligners may also cause increased damage to a patient’s bite that requires corrective action, including braces. Many customers reported that their progress was not monitored by a dental professional, nor were they able to obtain assistance from a dentist when they experienced pain.

The Better Business Bureau has collected over 1,800 reports related to Smile Direct aligners, some of which pertain to pain and damaged teeth. Several members of Congress requested that the Food and Drug Administration and the Federal Trade Commission look into Smile Direct Club to determine whether it is deceiving and harming consumers. Dental experts agree that proper alignment of the teeth and jaw requires in-person visits, and that wearing improperly fitting aligners or aligners that move the teeth too quickly may lead to permanent harm. Patients who have experienced serious damage and tooth loss have filed lawsuits against Smile Direct Club for negligence, failure to warn, and other claims.
