What is the Statute of Limitations for Sexual Abuse Lawsuits in New Jersey?

Sexual abuse lawsuits are civil legal actions that are subject to a legal deadline known as the statute of limitations. When the statute of limitations for a claim expires, victims are no longer able to file lawsuits or recover compensation.

Fortunately, New Jersey has followed suit with other states to pass legislation that provides sexual abuse survivors – and particularly those who were abused as minors – with more time to file claims.

The statute of limitations for civil sexual abuse lawsuits under current New Jersey law is as follows:

• Adults sexually abused or assaulted when age 18 or older have seven years from the date the abuse occurred or seven years from the date of discovery, whichever is later, to file a lawsuit.
• Survivors of childhood sexual abuse (abuse that occurred when they were under the age of 18) have until the age of 55 or seven years from the date of discovery, whichever is later, to file civil lawsuits.
